Terms and conditions
Last updated September 16, 2026
These Terms and conditions (“Terms”) are a contract between you and Simba Services (“we,” “us”) for use of Energy Beacon — the website at ebeacon.simba.services, the iOS app, and the Google Play app (together, the “Service”). Seat subscriptions are billed by MP Solutions as merchant of record through Stripe.
By creating an account, signing in, or using the Service, you agree to these Terms and to our Privacy policy. If you do not agree, do not use the Service.
1. The Service
Energy Beacon is a professional workspace for searching and mapping wells, pipelines, and waste-disposal sites in Texas, New Mexico, Oklahoma, and Louisiana. It is provided for informational and operational planning use by people in the oil and gas industry and related work.
Energy Beacon is workplace software sold to organizations. Seats are billed per person on the website (Safari or Chrome) through Stripe Checkout. Cards are collected by Stripe for MP Solutions. The iOS and Google Play apps open the same signed-in workspace; they are not general-purpose browsers, they do not sell in-app purchases, and they do not collect payment. App Store and Play billing are not used for Energy Beacon access.
2. Eligibility and accounts
- You must be at least 18 and able to form a binding contract.
- You must provide a valid work email and a password, and keep them accurate and confidential.
- You are responsible for activity under your account.
- People with email on the same company domain are grouped into one organization and share that organization’s seats. The first account on a domain is the organization admin and can change seats, roles, or members. Removing someone from an organization is not the same as deleting their account.
- You may delete your own account at any time: Account → Delete account.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to access another person’s account or data without permission.
- Probe, scan, or disrupt the Service, or overload it with automated requests beyond ordinary use.
- Scrape, resell, or republish the Service as a competing product, or remove notices from the interface.
- Use the iOS or Google Play app as a general-purpose browser or to open arbitrary websites.
- Misrepresent well, pipeline, or waste-site information obtained from the Service as an official survey, as-built, or excavation locate.
4. Data sources and no excavation or survey use
Locations, permits, operators, statuses, and other records are compiled from public regulatory and published sources (including state oil and gas commissions and related datasets). Those sources can be incomplete, delayed, or wrong.
Do not use the Service to excavate, drill, or disturb the ground. Pipeline and well locations in the Service are not a substitute for a One Call / 811 locate, an as-built survey, or operator drawings. Call 811 (or the local one-call center) before you dig.
The Service is not professional engineering, surveying, legal, or title advice. Confirm critical facts against official agency records and your own field procedures before you act.
5. Your content
Saved wells and search history are your workspace data. You grant us a limited license to store and display that data so the Service can function for you and, where applicable, your organization. You represent that you have the right to save and view the records you look up in the course of your work.
6. Intellectual property
The Service — including its software, design, and compilation of public records into this workspace — is owned by Simba Services or its licensors. Public regulatory records remain subject to the terms of the agencies that published them. These Terms do not transfer ownership of those records to you, and they do not transfer ownership of the Service to us beyond the license you need to use it.
7. Third-party services
Maps may open in Apple Maps or Google Maps, and map tiles may load from Esri, OpenStreetMap, USGS, or similar providers. Those services are governed by their own terms. We are not responsible for them.
8. Availability
We aim to keep the Service available but do not guarantee uninterrupted access, complete datasets, or that every well, pipeline, or waste site in a state is present or current. We may change, suspend, or discontinue features.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT COORDINATES, PERMITS, OPERATOR NAMES, STATUSES, OR PIPELINE ROUTES ARE ACCURATE, COMPLETE, OR FIT FOR NAVIGATION, EXCAVATION, DRILLING, OR REGULATORY FILING.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMBA SERVICES AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING FROM THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow certain limitations. In those places, the limits apply to the fullest extent allowed.
11. Indemnity
You will defend and indemnify Simba Services against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your violation of these Terms, or your use of Service data for excavation, drilling, navigation, or any purpose we have warned against.
12. Suspension and termination
We may suspend or close an account that violates these Terms or that presents a security or legal risk. You may stop using the Service and delete your account at any time. Sections that by their nature should survive (including 4, 6, 9–11, and 13) survive termination.
13. Governing law
These Terms are governed by the laws of the United States and the state in which Simba Services maintains its principal place of business, without regard to conflict-of-law rules. Courts in that state will have exclusive jurisdiction, except that we may seek injunctive relief in any forum to protect the Service.
14. Changes
We may update these Terms. The “Last updated” date will change, and the new Terms will be posted at /terms. If you continue to use the Service after an update, you accept the revised Terms. If you do not agree, stop using the Service and delete your account.
